RACCOLTA E CONSERVAZIONE DEI DATI PERSONALI E NATURA E FINALITÀ DEL LORO UTILIZZO

Durante la consultazione del sito web

Al momento dell’accesso al sito web www.pattilex.com vengono inviate automaticamente dal browser utilizzato alcune informazioni al server del nostro sito. Queste informazioni vengono salvate temporaneamente in un cosiddetto logfile. In questo processo, senza alcun intervento da parte Sua, vengono raccolte e salvate, sino ad una cancellazione automatica, le seguenti informazioni:

TRASMISSIONE DEI DATI

La trasmissione dei dati personali a terzi non avviene per fini diversi da quelli di seguito indicati. Tuttavia, in seguito al conferimento del mandato, i Suoi dati possono essere trasmessi al fine dell’esecuzione del mandato stesso – internamente alla nostra organizzazione nelle sedi di Patti Avvocati & Rechtsanwälte a Roma, Milano e Monaco.

Trasmettiamo i Suoi dati personali a terzi solo se:

  • ha espresso il suo consenso al trattamento dei propri dati personali per una o più specifiche finalità ai sensi l’art. 6, comma 1, lett. a) GDPR;
  • la trasmissione dei dati personali è necessaria per il perseguimento del legittimo interesse del titolare o di terzi ai sensi dell’art. 6, comma 1, lett. f) GDPR, a condizione che non prevalgano diritti preminenti dell’interessato;
  • la trasmissione è necessaria ai sensi dell’art. 6, comma 1, lett. c) GDPR per adempiere un obbligo legale;
  • la trasmissione è lecita e necessaria ai sensi dell’art. 6, comma 1, lett. b) GDPR per dare esecuzione di un contratto di cui l’interessato è parte.

Inoltre, può richiedere che siano rettificati o cancellati i dati personali, che il loro trattamento sia limitato ovvero può opporsi al trattamento, può proporre reclamo ad un’autorità di controllo. Qualora i dati non siano raccolti presso l’interessato, ha il dritto di ricevere tutte le informazioni disponibili sulla loro origine. Qualora i dati siano trasferiti in un paese terzo o ad una organizzazione internazionale, il diritto ad essere informato sul rispetto delle garanzie di cui all’art. 46 GDPR.
  • ai sensi dell’art. 16 GDPR l’interessato ha il diritto di ottenere dal Titolare del trattamento, senza ingiustificato ritardo, la rettifica dei dati personali inesatti o l’integrazione dei dati personali incompleti che lo riguardano;
  • ai sensi dell’art. 17 GDPR l’interessato ha il diritto di ottenere dal Titolare del trattamento, senza ingiustificato ritardo, la cancellazione dei dati personali che lo riguardano (diritto all’oblio), salvo che il trattamento non sia necessario per l’esercizio del diritto alla libertà di espressione e di informazione, per l’adempimento di un obbligo legale, per motivi di interesse pubblico o per l’accertamento, l’esercizio o la difesa di un diritto in sede giudiziaria;
  • ai sensi dell’art. 18 GDPR l’interessato ha il diritto di ottenere dal Titolare del trattamento la limitazione del trattamento, ove contesti l’esattezza dei dati personali, ove il trattamento sia illecito ma l’interessato si opponga alla loro cancellazione, benché il Titolare del trattamento non ne abbia più bisogno per le finalità del trattamento, dal momento che i dati personali sono necessari all’interessato per l’accertamento, l’esercizio o la difesa di un diritto in sede giudiziaria. L’interessato ha il diritto di ottenere la limitazione del trattamento anche nel caso in cui ha esercitato il proprio diritto di opposizione ai sensi dell’art. 21 GDPR;
  • ai sensi dell’art. 20 GDPR l’interessato ha il diritto di ricevere, in un formato strutturato, di uso comune e leggibile da dispositivo automatico, i dati personali che lo riguardano forniti al Titolare del trattamento e ha il diritto di richiederne la trasmissione a un altro titolare;
  • ai sensi dell’art. 7, comma 3 GDPR l’interessato ha il diritto di revocare il proprio consenso in qualsiasi momento con la conseguenza che il Titolare del trattamento non prosegue il trattamento dei dati personali.
  • ai sensi dell’art. 77 GDPR l’interessato ha il diritto di proporre reclamo innanzi ad una autorità di controllo, segnatamente dello Stato membro in cui risiede abitualmente, dove lavora oppure del luogo ove si è verificata la presunta violazione.

DIRITTO DI OPPOSIZIONE

Nel caso in cui i Suoi dati personali siano trattati in base all’6, comma 1, lett. f) GDPR, l’art. 21 GDPR Le conferisce il diritto di presentare opposizione al trattamento dei suoi dati personali qualora sussistano motivi derivanti dalla Sua particolare situazione ovvero l’opposizione sia riferita al marketing diretto. In quest’ultimo caso sussiste un diritto all’opposizione generale che verrà tutelato senza la necessità di indicare una particolare situazione.

SICUREZZA DEI DATI

Durante la consultazione del sito web utilizziamo un tipo diffuso di procedura, il cosiddetto metodo SSL (Secure Socket Layer), in combinazione con il più alto livello di crittografia supportato dal browser utilizzato. Generalmente, si tratta di una cifratura di 256 bit. Nel caso in cui il browser non supporti una cifratura di 256 bit, ricorriamo alla tecnologia di 128 bit v3. Lei stesso può riconoscere se una singola pagina web del nostro sito viene trasmessa in forma cifrata dal simbolo di una chiave o di un lucchetto chiuso che apparirà nella barra di stato inferiore del browser.

Ci serviamo peraltro di misure di sicurezza tecniche ed amministrative appropriate per salvaguardare i dati raccolti da manipolazioni accidentali o intenzionali, da perdite parziali o totali, da distruzione o dall’accesso da parte di persone non autorizzate. During the consultation of the website

When accessing the website www.pattilex.com the browser on your device sends automatically information to the server of our website. This information is temporarily stored in a so-called log-file. During this process, without any intervention from your side, the following information iscollected and stored until an automatic deletion:

These pieces of information are processed by us for the following purposes:

TRANSMISSION OF DATA

The transmission of personal data to third parties does not occur for purposes different than the ones stated in the following. However, after the issuing of the mandate, your data can be transmitted internally – for the purpose of executing the mandate – among our organization in the Patti Avvocati & Rechtsanwälte offices in Rome, Milan and Munich.

We transmit your personal data to third parties only if:

  • you gave your consent to the processing of your personal data for one or more specific purposes according to Art. 6, para. 1, lett. a) GDPR;
  • the transmission of personal data is necessary for the purposes of the legitimate interests pursued by the data controller or by a third party according to Art. 6, para. 1, lett. f) GDPR, under the condition that the data subject’s prominent rights do not prevail;
  • the transmission is necessary according to Art. 6, para. 1, lett. c) GDPR in order to fulfil a legal obligation;
  • the transmission is legitimate and necessary according to Art. 6, para. 1, lett. b) GDPR in order to execute a contract the data subject is a party of.

COOKIES

We use so-called cookies on our website. These are small text files that your browser automatically creates and which will be stored on your end device (laptop, tablet, smartphone or similar) when consulting our website. A differentiation is made between strictly necessary cookies, performance cookies, analytical cookies, functional cookies and advertisement cookies. The allocation results from the legal basis of the cookies, where in the case of the strictly necessary cookies, according to Art. 6, para. 1, lett. f) GDPR & § 25 para. 2 TTDSG, no consent of the user is required due to a legitimate interest of Patti Avvocati & Rechtsanwälte or due to the indispensability of storing the information for the transmission of a message. Therefore, cookies that are strictly necessary are always active. All other types of cookies (performance cookies, analytical cookies, functional cookies and advertisement cookies) require an explicit consent from our users (Art. 6 para. 1, lett. a), f) GDPR & § 25 para. 1 TTDSG). The required consent is displayed on our cookie banner when entering on the website. If the consent is given successfully, the cookies are activated immediately or when reloading the website. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware.

The cookie configuration can be adjusted at any time under cookie settings. Thus, a consent already given can also be withdrawn, but legal cookies remain active until the end of their runtime. Additionally, you can configure your browser, so that no cookies are stored on your device or that anotice appears every time before a new cookie is created. As data subject you have the following rights:

  • according to Art. 15 GDPR, the right to obtain confirmation as to whether or not personal data concerning him or her are being processed; in this case you have the right to access the personal data and require information, such as the purposes of the proceeding, the categories of personal data concerned, the recipients or categories of recipient to whom the personal data have been or will be disclosed and the envisaged period for which the personal data will be stored. Moreover, you have the right to request rectification or erasure of personal data, restriction of processing personal data and you can object to such processing, as well as lodge a complaint with a supervisory authority. In case the data are not collected from the data subject, you have the right to receive any available information as to their source. In case data are transferred to a third country or to an international origination, you have the right to be informed as to the appropriate safeguards pursuant to Art. 46 GDPR;
  • according to Art. 16 GDPR, you have the right to obtain from the data controller without undue delay the rectification of inaccurate personal data concerning you or the completion of incomplete personal data;
  • according to Art. 17 GDPR, you have the right to obtain from the data controller the erasure of personal data concerning you without undue delay (right to be forgotten), unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or the defence of legal claims;
  • according to Art. 18 GDPR, you have the right to obtain from the data controller restriction of processing when you contest the accuracy of the personal data, when the processing is unlawful but you oppose the erasure or when the data controller no longer needs the personal data for the purposes of the processing but they are required by you for the establishment, exercise or defence of legal claims. You have the right to obtain the restriction of the processing also in case you have exercised your right to object pursuant to Art. 21 GDPR;
  • according to Art. 20 GDPR, you have the right to receive the personal data concerning you, which you provided to the data controller, in a structured, commonly used and machine-readable format and have the right to require the transmittal to another data controller;
  • according to Art. 7, para 3 GDPR, you have the right to withdraw your consent at any time, with the consequence that the data controller shall no longer pursue the processing of the personal data;
  • according to Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement.

RIGHT TO OBJECT

In case your personal data are processed according to Art. 6, para. 1, lett. f) GDPR, Art. 21 GDPR you have the right to object to the processing of your personal data on grounds relating to your particular situation or the objection is related to direct marketing. In this case, a general right to object exists, that will be protected without the necessity to indicate a particular situation.

DATA SECURITY

During the consultation of the website, we use a common type of procedure, the so-called SSL (Secure socket layer), in conjunction with the highest level of encryption supported by the used browser. Generally, it is a 256 bit crypto. In case the browser does not support a 256 bit crypto, we turn to the 128 bit v3 technology. You can recognize if a single page of our website is transmitted in encrypted form from the symbol of a key or a closed lock that will appear on the bottom status bar of your browser.

Moreover, we use appropriate technical and administrative security measures in order to protect the collected data from any accidental or intentional manipulation, from partial or complete loss, destruction or access by non-authorized persons.
